Geeks don’t get mad, they get even.

Apple Computer is facing a lawsuit over claims that the company knew its nano portable music device was defective but gave its release the green light anyway.

Apple lawyers are still waiting to hear whether the suit filed last week in San Jose will be class action or a series of individual complaints.

Here’s an excerpt from the Reuters report:

“The complaint blames the nano’s defectiveness on the film of plastic resin that covers it to protect it from damage. Previous versions of the iPod were coated with thicker and stronger resin, the suit says. ‘Rather than admit the design flaw when consumers began to express widespread complaints …Apple concealed the defect and advised class members that they would need to purchase additional equipment to prevent the screen from scratching excessively.”

Complainants are seeking a refund of the $25 dollar fee they paid to return their banged-up nanos along with a refund of the purchase price and “several other forms of damages” that we can only guess have something to do with “diminished approval of peers” and “severe loss of cool.”.
